REFUND AND RETURN POLICY - FOOD PRESERVE
1. General Overview By purchasing products from Food Preserve ("the Store"), the customer ("the Customer") acknowledges and agrees to adhere to the terms, conditions, stipulations, and clauses outlined in this Refund and Return Policy. This policy constitutes a binding legal agreement between the Customer and the Store, governing all transactions, including but not limited to purchases, returns, exchanges, and disputes arising from such transactions. The Customer further acknowledges that their use of the Store's services implies a thorough understanding and acceptance of these terms.
2. Returns Allowed with Email Notification Returns are permitted exclusively under the condition that the Customer sends a detailed email to Team@food-preserve.com within 30 calendar days from the original purchase date. The email must include the Customer's full name, order number, date of purchase, a comprehensive explanation of the reason for the return request, and supporting documentation as necessary, such as photographs, receipts, or other relevant evidence. Requests submitted after the aforementioned 30-day period will be deemed invalid and categorically denied. Furthermore, any incomplete or insufficiently detailed email requests will not be processed, and the Store reserves the right to reject any return request that fails to comply with these precise requirements.
3. Defective or Damaged Items In the uncommon scenario where the Customer receives a defective or damaged item, it is imperative that the Customer notifies the Store by emailing Team@food-preserve.com no later than 7 calendar days following the receipt of the item. The notification must include high-resolution photographic evidence clearly depicting the defect or damage, along with a written description outlining the issue in detail. The Store retains sole discretion to determine the appropriate course of action, which may include, but is not limited to, issuing a replacement, a partial refund, or a full refund. The Store's decision shall be final and binding.
4. Return Shipping Costs In cases where a return is authorized, regardless of the underlying reason, the Customer shall bear full responsibility for all return shipping costs, including but not limited to postage fees, packaging materials, and any applicable customs duties or taxes. These costs are strictly non-refundable under any circumstances unless explicitly stated otherwise in writing by an authorized representative of the Store. The Customer is advised to use a traceable shipping service for all returns, as the Store will not be liable for lost or misdirected packages.
5. Conditions for Return - Electronic Devices Items eligible for return must meet the following stringent criteria: (a) The item must be COMPLETELY UNOPENED in its original factory-sealed packaging. Any product with a broken seal, opened box, or evidence of tampering will be automatically rejected unless the Customer has received explicit written authorization from Food Preserve customer support via email at Team@food-preserve.com; (b) All original packaging materials, accessories, cables, manuals, documentation, warranty cards, and promotional materials must be included in pristine, untouched condition; (c) The product serial number and packaging must match and remain intact; (d) No software, firmware, or digital components may have been accessed, downloaded, activated, or registered. The Store reserves the absolute right to reject any return that does not fully comply with these conditions. Any opened, used, or altered electronic devices will be refused for return and shipped back to the Customer at the Customer's expense unless prior written approval has been granted by Food Preserve customer support. Additionally, the Customer may be subject to a restocking fee of up to 25% of the purchase price, at the sole discretion of the Store, for any returned items, even those in unopened condition.
6. Indemnification The Customer agrees to indemnify, defend, and hold harmless Food Preserve, its officers, employees, agents, affiliates, and successors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to the Customer's purchase, misuse of the product, or violation of this Refund and Return Policy. This indemnification obligation shall survive the termination of this Policy.
7. Policy Amendments Food Preserve reserves the unilateral right to modify, amend, or revise this Refund and Return Policy at any time without prior notice. Any such amendments shall be effective immediately upon publication on the Store's website or other official communication channels. The Customer's continued use of the Store following the implementation of any changes constitutes an acknowledgment of and agreement to the revised terms.
8. Governing Law This Refund and Return Policy, as well as any disputes arising therefrom, shall be governed by, construed, and enforced in accordance with the laws of the United States, excluding its conflict of law principles. The Customer agrees to submit to the exclusive jurisdiction of the courts located within the United States for the resolution of any disputes.
9. Chargeback Policy If the Customer fails to adhere to the explicit requirement of contacting the Store via email at Team@food-preserve.com to address any complaint, dispute, or return request and instead initiates a chargeback with their financial institution, the Customer explicitly consents to the automatic rejection of such chargeback on the grounds of non-compliance with this Refund and Return Policy. By proceeding with a purchase, the Customer irrevocably agrees to abide by this provision.
